I have known W. Charles Sipio for over ten years now and found him to always be extremely responsible, independent, and hard working. Charles Sipio was a student in two of my classes while he was enrolled at Saint Joseph's University. He came to Saint Joseph's as a transfer student from Temple. In reflecting on the students I have taught during my forty years at Saint Joseph's, academically they fall into four distinct categories: those that do well from the start and continue to excel right up to graduation; those who never rise above the middle or even the bottom throughout their craeer; those who sparkle at first, by fall by the wayside; and, finally those that get a rough start and then finish well. Although no teacher would say that he or she did not want more of the first type, there is frequently, in my opinion, more satisfaction in the latter class of student. Charlie is a fine example. His performance in his first class with me, Religion and American Politics was mediocre. As a result, I did not expect anything more from him when he enrolled in the Senior Seminar on Religious Liberty during the spring of his senior year. In fact, given that he had only a few months before graduation, I would not have been surprised were his performance to have been even less impressive than his earlier one with me. That certainly was the case with many of the students in the class. I was to be surprised at least by Charlie! The course is structured as a simulation of the United States Supreme Court with the students alternating in the roles of attorneys before the Court and as justices. The cases are drawn from actual cases dealing with either free exercise or establishment issues. Charlie was superb and gave the student who eventually won the awrd as the best major in 2009 a run for her money. His brief was particularly outstanding. He represented the state of Utah, defending its statute criminalizing polygamy from a challenge that it violated the individuals' free exercise right and right to marry as well as the right of privacy. Charlie used the htbrid test of Smith to his advantage and carefully and skillfully distinguished this case from the Lawrence and Loving opinions. Assuming the role of justice, Charlie wrote an opinion on a particularly difficult case, the issue of church backruptcy. The student I encountered in the last semester of his senior year had been totally tgransformed. I wish I could take credit, but I am too long in the tooth not to understand that it was the subject matter of the law, the need to draw lines and not I that ignited a very talented individual.
