I was a creditor in a bankruptcy in which the debtors received a sizable inheritance. While they had previously agreed to owing me an amount with interest, they found what they thought was evidence that they owed me much less. The debt was incurred while they lived in Oregon, and were what I thought to be very close friends. Since the bankruptcy was filed in Colorado, it was paramount to have representation of a Colorado attorney. It was like hitting the jackpot that my attorney was Ethan Birnberg! Not only does Ethan have excellent communication skills, but he provided a realistic, concise, reassuring strategy in dealing with the debtors' departures from the facts involved in the case as well as their seemingly endless unavailability to discuss my position. That Ethan provided consistent updates on how the case was proceeding, along with checking to make certain that I was in total agreement with his plan, gave me a tremendous amount of confidence that the end result would be a favorable one. In the end the debtors must have realized that they would be unable to prevail in court and agreed to settle for what was owed me. I live in Idaho and had loaned money years ago to individuals I thought were like family. Needless to say a mistake, they filed for Chapter 13 bankruptcy in Colorado ( they now reside in Evergreen) several years ago and I had totally written off the loan on my taxes filed for 2016etc.. ( fairly substantial to me). In becoming aware that one of them had inherited a substantial sum a bankruptcy attorney I know here in Idaho found Ethan for myself and another friend who had also loaned the same individuals money. Needless to say the debtors had serious revisionist history and obviously had no intention of notifying the bankruptcy trustee of their windfall and making good on their commitments . Thank goodness for good documentation and Ethan. From the start he was not only professional to deal with but an excellent communicator. He also has a great sense of humor ( nice thing in this type of situation). It was clear from the beginning that he sincerely wanted to get what was due to me and also sensitive to minimizing billable hours. He also was professionally assertive in following up with the Bankruptcy Trustee who I frankly do not believe was aggressive enough in going after them on the inheritance. (My Idaho Attorney had informed the trustee over a year ago that the individual's mother had passed away and nothing was happening.) Ethan represented me in a proceeding, negotiated on my behalf to get the entire principal back and additional compensation that given what they had paid before in principal more than made up for the interest due. He was truly a pleasure to deal with the entire time, always very responsive to questions, kept me apprised and as I said great personality. I would highly recommend him to anyone needing bankruptcy assistance. My CPA is Denver based ( done my work for over 30 years) and I have already told her if any clients need this type of assistance I know exactly who they should hire!
